Scope and Application - Prize Draw Terms

These terms and conditions (Draw Terms) set out the rules which apply to Draws operated by Raise Your Game Ltd (RYG, We, Us) otherwise than in association with a Nominated Charity (Global Draws) and Draws operated by RYG in association with a Nominated Charity (Host Draws). These Draw Terms also apply to Subscriptions for Host Draws and Subscriptions for Global Draws.

All Draws and Subscriptions are available via the Website. In the case of Host Draws and Subscriptions for Host Draws, You will be directed to the Website via the Host’s Landing Page.

All Host Draws and all Subscriptions for Host Draws, are specific to the Host (and the separate Nominated Charity, if the Host is not itself the Nominated Charity) to which the Host Draw applies, and which will be identified on that Host’s Landing Page and/or the Additional Terms on that Host’s Landing Page. Please also visit Our Website (at Raise Your Game) for details of current Hosts (and each such Host’s Nominated Charity, where the Host itself is not the Nominated Charity) and links to the relevant Host’s Landing Pages.

RYG controls and operates the Website and each of the Host’s Landing Pages.

The additional terms available on the Host’s Landing Page (Additional Terms) which will also apply to You, and which supplement these Draw Terms; The Host’s privacy policy available on the Host’s Landing Page (Host’s Privacy Policy) which sets out how the Host as an independent Controller (and the Nominated Charity as an independent Controller, if the Host is not itself the Nominated Charity), will process any personal data about You which We share with it/them.

Contract

By entering any Draw and/or any Subscription, You confirm that You have read and accept these Draw Terms (as such terms are updated from time to time) and agree to be bound by them and that You have read and understood the RYG Privacy Policy.

By entering into a Host Draw and/or a Subscription for Host Draws, You also confirm that You have read and accept the Additional Terms and agree to be bound by them (as such terms are updated from time to time) and that You have read and understood the Host’s Privacy Policy.

Each Entry for a Draw, other than a Subscription Entry, constitutes a contract between RYG and You, comprising these Draw Terms (and, in the case of Host Draws, the Additional Terms).

If You have a Subscription, the Subscription itself constitutes a contract between RYG and You as the Subscriber, comprising these Draw Terms (and, in the case of Subscriptions for Host Draws, the Additional Terms) and which covers all Subscription Entries relevant to that Subscription.

The Host (and/or the separate Nominated Charity if the Host is not itself the Nominated Charity) is not a party to any such contract between You and RYG.

Definitions

In these Draw Terms, the following words shall have the following meanings:

• Automatic Global Entry: an entry for a Global Draw which an Entrant for a Host Draw is automatically entered into by RYG, in accordance with clause 4.6. Closing Date: The closing date and deadline for each Draw.
• Draw: Any draw operated by RYG for the opportunity to win a Prize.
• Entrant: Any individual who submits an Entry, or for whom an Entry who is automatically submitted by RYG, in accordance with these Draw Terms and (if the Draw is a Host Draw) the Additional Terms.
• Entry: any of (i) a validly submitted, completed entry for an individual Global Draw or individual Host Draw (whether via a Paid Entry or Free Postal Entry); (ii) a Subscription Entry; and/or (iii) an Automatic Global Entry.
• Free Postal Entry: a validly completed and submitted postal Entry in accordance with clause 5 which is not subject to a payment by You.
• Host’s Landing Page: the web page owned, operated and controlled exclusively by RYG, but which is dedicated to the specific Host (and the separate Nominated Charity where the Host itself is not the Nominated Charity) identified on that web page.
• Host: the person identified as such on the Host’s Landing Page and/or the Additional Terms.
• Nominated Charity: the person identified as such on the Host’s Landing Page and/or the Additional Terms, and being a charity, philanthropic or benevolent organisation which receives a proportion of the funds raised from Host Draws and Subscriptions for Host Draws.
• Paid Entry: an online Entry for which a payment is made by You, whether or not pursuant to a Subscription.
• Prize: the prize for a particular Draw, which in the case of Host Draws will be stated in the Additional Terms and/or the Host’s Landing Page and which in the case of Global Draws will be stated on the Website.
• Subscription: a subscription for Host Draws or a subscription for Global Draws, entered into by You with RYG.
• Subscriber: the person entering into a Subscription with RYG.
• Subscription Entry: an entry for a Draw which RYG automatically enters Subscribers for, pursuant to a Subscription, in accordance with clause 4.5 or clause 4.11.
• You: the Subscriber and/or Entrant.
• Random Number Generator: Certified Random Number Generator software which will be used by RYG to select the Winner of each Draw.
• Website: https://www.raise-your-game.com/.
• Winner: The Entrant (or, where multiple prizes are available, Entrants) chosen at random using the Random Number Generator who wins the Prize(s).

In these Draw Terms, the following rule of interpretation shall apply: Any words following the terms including, include, in particular, for example or any similar expression shall be interpreted as illustrative and shall not limit the sense of the words preceding those terms.

A reference to a statute or statutory provision is a reference to it as amended, extended or re-enacted from time to time.

A reference to writing or written includes email.

A person includes a natural person, corporate or unincorporated body (whether or not having separate legal personality) and that person's personal representatives, successors or permitted assigns.

Each of the terms, Controller, Processor, Data Subject, Personal Data, Personal Data Breach, Processing and appropriate technical and organisational measures shall have the meanings as defined in the Data Protection Legislation.

Eligibility

All Draws and all Subscriptions are open only to individuals over the age of 18.

Host Draws and Subscriptions for Host Draws are also subject to any additional eligibility criteria set out in the Additional Terms.

All Subscribers and all other Entrants using the Paid Entry route, must enter their details on the Website and provide their contact details including their postal address, e-mail address and a telephone number along with a valid card payment.

All Entrants using the Free Postal Entry Route, must provide the details and confirmations required by clauses 5.1 and 5.2.

For the avoidance of doubt, all Entries and all Subscriptions require a valid email address in order to notify the Winner of the Draw that they have won a Prize.

Draws and Subscriptions

Global Draws and Subscriptions for Global Draws

You can enter a Global Draw via Paid Entry route or via a Free Postal Entry route or by way of an Automatic Global Entry.

The Paid Entry route has two options available. You can either purchase a Subscription for Global Draws (entitling You to Subscription Entries) or You can pay to enter individual Global Draws. Please visit our Website for details of:

If You are a Subscriber for Global Draws, RYG will automatically enter You into all Global Draws (by way of Subscription Entries) which take place during Your Subscription.

Automatic Global Entries are available to Entrants for Host Draws and Subscribers for Host Draws. If You are a Subscriber for Host Draws, RYG will automatically enter You into all Global Draws which take place during Your Subscription, unless you opt not to be put forward for Global Draws. If you have opted out from being automatically entered into Global Draws, this does not prevent You from submitting a separate Entry for any individual Global Draw;

you are an Entrant for an individual Host Draw, RYG will automatically enter You into each Global Draw which take place during the period covered by that Host Draw unless you opt not to be put forward for Global Draws.

Host Draws and Subscriptions for Host Draws

You can enter a Host Draw via Paid Entry route or via a Free Postal Entry route.

The Paid Entry route has two options available. You can either purchase a Subscription for Host Draws (entitling You to Subscription Entries) or You can pay to enter individual Host Draws. Please visit the Host’s Landing Page and the Additional Terms for details of:

If You are a Subscriber for Host Draws, RYG will automatically enter You into all Host Draws (by way of Subscription Entries) which take place during Your Subscription.

Free Postal Entry

You can enter any individual Draw for free by sending a postcard or letter via stamped first- or second-class pre-paid post stating the Draw name they would like to enter, along with the following:

• Full name;
• Your age;
• Postal address;
• E-mail address;
• Contact telephone number;

If it’s a Host Draw, the name of the Host;

When entering a Draw using the Free Postal Entry route, as well as providing the information required from You under clause 5.1 above, You must also confirm:

That You have read and accept these Draw Terms and (if the Draw is a Host Draw) the Additional Terms; and That You have read and understood the RYG Privacy Policy and (if the Draw is a Host Draw) the Host’s Privacy Policy; and If You wish to receive future marketing communications (which may be by email, text or via social media channels) from Us; and (In the case of a Host Draw) if You wish to receive future marketing communications (which may be by email, text or via social media channels) from the Host; and (In the case of a Host Draw, where the Host is not itself the Nominated Charity) if You wish to receive future marketing communications (which may be by email, text or via social media channels) from the Nominated Charity; and (In the case of a Host Draw) if You wish to opt out from being also automatically included in the relevant Global Draw.

If You do not provide the information and confirmations required by clause 5.1, clause 5.2(a) and clause 5.2(b), we may treat your Entry as void, or we may contact You to confirm the same. If We cannot reach You, or You still do not provide the information and confirmations required by clause 5.1, clause 5.2(a) and clause 5.2(b), your Entry will be treated as void.

Falling to provide any of the confirmations referred to in clauses 5.2(c), 5.2(d), 5.2(e) or 5.2(e) above, will not invalidate Your Free Postal Entry and for the avoidance of doubt, You will not be deemed to have confirmed Your willingness to receive future marketing communications simply by not confirming that You do wish to receive them.

You can enter a Draw using the Free Postal Entry route as many times as You wish.

All details must be either typed or clearly written, we cannot enter You into a Draw if the writing on your postcard or letter is not legible. If We receive one postcard or letter containing multiple entries this will be treated as a single Entry.

Free Postal Entries must be sent to: Raise Your Game Ltd, Woolpack House, 70 Brinksway, Stockport SK3 0BY.

Free Postal Entries will be deemed to be submitted at the point of receipt by RYG. Free Postal Entries must be posted so that they are received by RYG no later than the Closing Date for each Draw. Free Postal Entries for a Draw received after the Closing Date for that Draw, will not be included in that Draw.

Bulk Free Postal Entries will not be permitted and Entries delivered to RYG in person will not be accepted.

Closing Date of the Draw

A Draw will close on the Closing Date for that Draw and which constitutes the deadline by which all Entries must be received.

Selection of the Winner

The Winner will be selected at random from all Entries using the Random Number Generator Software.

Any Winner whose payment transaction has been cancelled, reversed or is subject to any chargeback (before or after a Draw) will not be permitted to claim a Prize.

There will only be one Winner per Prize.

RYG will contact each Winner by e-mail, using the email address provided by the Entrant, to inform them that they have won the Prize.

The Winner(s) must respond to any call to actions in the email including, in the case of a cash Prize, providing their bank account details or debit card details in the case of a cash Prize or address in the case of a non cash Prize. If the Winner fails to provide the information requested, within 28 days of the email to the Winner notifying them that they have won the Prize, the Prize allocation to that Winner will be treated as void and another Winner will be randomly selected using the Random Number Generator from which the non-responsive Winner will be excluded. The alternative Winner will then be notified in the same way and the provisions of this cause will apply to that alternative Winner.

The original Winner will have no claim to a Prize once an alternative Winner has been selected.

We may also publicise details about Winners on the Website (and, in the case of Host Draws, on the Host’s Landing Page).

Winners of a Draw will be chosen and announced on the date(s) shown on the Website (in the case of Global Draws) and on the Host’s Landing Page and/or the Additional Terms (in the case of Host Draws).

The decision of RYG regarding any aspect of a Draw is final and binding and no correspondence will be entered into about it.

All Entries to the Draw are final and no refunds shall be made at any time or for any reason, except in the case of Entries submitted after the Closing Date for the relevant Draw or if RYG cancels the Draw.

Prizes

Details of the Prizes will (in the case of Host Draws) be stated in the Host’s Landing Page and/or the Additional Terms and (in the case of Global Draws) will be stated on the Website.

You acknowledge that an Entry does not guarantee that You will win a Prize.

In respect of Host Draws for non-cash prizes, the Host will provide the non-cash Prize directly to the Winner, and will contact the Winner to arrange delivery or collection, and this will depend on the nature of the non-cash Prize. Any collection of a non-cash Prize is the sole responsibility of the Winner. Unless alternative arrangements are agreed between the Winner and the Host, the non-cash Prize must be collected from the Host’s address as specified for such purposes. If the non-cash Prize is to be delivered to the Winner, the Host will pay for the cost of delivering the non-cash Prize to the Winner at Winner’s address.

In respect of Global Draws for non-cash prizes, RYG will provide the non-cash Prize directly to the Winner, and will contact the Winner to arrange delivery or collection, and this will depend on the nature of the non-cash Prize. Any collection of a non-cash Prize is the sole responsibility of the Winner. Unless alternative arrangements are agreed between the Winner and RYG, the non-cash Prize must be collected from RYG’s address as specified for such purposes. If the non-cash Prize is to be delivered to the Winner, RYG will pay for the cost of delivering the non-cash Prize to the Winner at Winner’s address.

Title to non-cash Prizes does not pass to the Winner until it is handed over to the Winner. Once the Winner takes possession of the Prize all risk and title in the Prize passes to the Winner.

To the maximum extent permitted by law, neither RYG nor the Host gives any warranty in relation to non-cash Prizes or the value or condition of that Prize.

The Prize is as stated in each Draw. If the Prize is a non-cash Prize, no cash alternative or alternative Prize will be offered to the Winner.

Cash Prizes will be transferred by RYG to the Winner’s bank account subject to the Winner meeting any requirements stipulated in these Draw Terms (and, in the case of Host Draws, the Additional Terms), and the Winner providing valid details of its accounts so as to enable such a transfer.

The Winner may be required to provide proof of their identity and/or age on or before the time the Prize is collected or delivered.

The Winner is responsible for all taxes, duties, and charges in relation to receipt of the Prize.

Limitation and exclusion of liability

Nothing in these Draw Terms shall limit RYG’s liability for personal injury or death resulting from its negligence, fraud, fraudulent misrepresentation, wilful default, or for any liability which cannot be excluded or limited by law.

RYG accepts no liability for errors or omissions contained within the Prize details, description or specification or any other part of the Website and/or Host’s Landing Page. It is the responsibility of each Entrant (and in particular the Winner) to satisfy itself as to the accuracy of any such details and/or any content of the Website and/or Host’s Landing Page.

RYG will not be liable for any loss suffered by an Entrant or Subscriber as a result of:

Entries which do not comply with these Draw Terms or (where applicable) the Additional Terms; or

Entries not received (or received late) due to failures in IT or telecommunications systems or other malfunctions, hardware failure, software failure, server faults or any other reason (including failures of the postal system); or

Entries which are in an incomplete or illegible format; or

A breach by the Entrant or Subscriber of the Website Use Terms or Acceptable Use Policy (including any failure to keep passwords and account details secure); or Any use of the Website and/or Host’s Landing Page or any inability to access the same.

RYG shall not be liable to You, for:

Any loss of revenue, contract, profits, business or anticipated savings or loss of data; or

Any special or indirect or consequential losses; or

Any loss of goodwill or reputation; or

Any loss of opportunity to enter a Draw and/or receive a Prize.

An Entry shall be treated as void (without any refund being given) if the Entrant engages in: (a) any form of fraud (actual or apparent); (b) fraudulent misrepresentation; (c) fraudulent concealment; (d) hacking or interference with the proper functioning of the website; or (e) amending, or unauthorised use of, any of the code that constitutes the Website or Host’s Landing Page.

Subject to each of the other provisions in this clause 9, RYG’s liability to an Entrant or Subscriber shall be limited to the amount paid by that Entrant or Subscriber under the contract between RYG and that Entrant or Subscriber.

Miscellaneous

RYG will publish information indicating that the Draw took place, and a Winner was awarded the Prize(s). The Winner will be given the option to consent to RYG displaying their full name, town of residence and photograph and/or video on the RYG Website and (in the case of Host Draws) the Host’s Landing Page. Where consent is given, the Winner’s name, town and photo and/or video will be posted on the Website and (in the case of Host Draws) the Host’s Landing Page.

RYG reserves the right to amend these terms and conditions at any time. Any changes will be immediately published on the Website, and it is each Entrant’s responsibility to check the Website for any changes to these terms and conditions.

Each contract between RYG and an Entrant or Subscriber is governed by the laws of England and Wales and acknowledge that the courts of England and Wales will have exclusive jurisdiction in the event of any dispute arising out of any such contract and/or Draw or its administration.

Entrants agree that any applicable requirement under the Consumer Protection (Distance Selling) Regulations 2000 for any goods and services ordered online to be supplied within 30 days will not apply to Draws.

Cancellation

RYG reserves the right to cancel any Draw at any time either before or after Entries have been received. If a Draw is cancelled, the Promoter will notify each Entrant at the email address they have provided and return any payment made by an Entrant to RYG by the same method as payment was made. Where a payment has been refunded, RYG will have no further liability to the Entrant or to any other person.

Rejection, Disqualification and Termination

If an Entrant (or prospective Entrant) is found to be under the age of 18 or not satisfying any other relevant eligibility criteria (whether for Entrants or Subscribers), or their Entry does not satisfy the requirements under these Draw Terms (and, the Additional terms, in the case of Host Draws), RYG may:

reject or disqualify their Entry or otherwise treat it as void; and/or

treat any Prize allocation to that Entrant as void; and/or

terminate the contract with that individual with immediate effect.

If a Subscriber (or prospective Subscriber) is found to be under the age of 18 or not satisfying any other relevant eligibility criteria (whether for Entrants or Subscribers), RYG may:

reject their Subscription; and/or

terminate the contract with that individual with immediate effect; and/or

take any other action specified in clause 12.1 with respect to Entries and Prizes.

RYG also reserves the right to reject an Entry, disqualify any Entrant, treat any Prize allocation to an Entrant as void and/or terminate the contract with the Entrant or Subscriber, if that Entrant or Subscriber fails to make any payment due from them by the due date and/or if RYG has reasonable grounds for believing that the Entrant or Subscriber has breached any of these Draw Terms (or the Additional Terms in the case of Host Draws and Subscriptions for Host Draws) or acted in a way that is reasonably considered by RYG to be illegal or unethical.

Data and Privacy Policy

Each Entrant and Subscriber, recognises that RYG will use contact details and other personal data supplied by an Entrant or Subscriber to RYG to both administer the Website, administer Subscriptions and to conduct Draws in accordance with these Terms and Conditions and as set out in RYG’S Privacy Policy.

Each Entrant and Subscriber, recognises that RYG may share or disclose their personal data to third parties as set out in the RYG Privacy Policy, including relevant Hosts and Nominated Charities.

We will not direct marketing communications to you unless you have expressly opted in to receive the same. If You do opt in, You have the right to opt out at any time. Please refer to the RYG Privacy Policy for further details.
